Applicant Disclosure and Authorization for Consumer Reports
Scroll to read

Last updated: September 17, 2026.

PLEASE READ THIS DOCUMENT CAREFULLY. This document tells you that a background check (called a "Consumer Report" under federal law) may be obtained about you in connection with your application to rent a home. To continue with your application, you will check a box giving your permission for that to happen. You have important rights under the federal Fair Credit Reporting Act (the "FCRA") and your state’s laws. These rights are summarized below.

PART A — DISCLOSURE
A.1 A Consumer Report May Be Obtained About You.

In connection with your application for tenancy, the landlord, property manager, or other authorized user (the "Subscriber") has asked us, Lotly Software LLC (operator of lotly.ai) ("we," "us," "our," or "Lotly"), to obtain a Consumer Report about you. A "Consumer Report" is a report containing information about you that is regulated by the FCRA and similar state laws.

A.2 What Information the Report May Include.

Depending on which Services the Subscriber has selected, the Consumer Report may include any or all of the following types of information:

  • Credit information — your credit history, credit accounts, payment history, balances, public-record items affecting credit, and credit scores.
  • Criminal-history information — records of criminal convictions and pending criminal cases.
  • Housing-records information — records of past housing-court proceedings.
  • SSN trace — on screening tiers that include TLO data, the Social Security number you provide may be matched against historical name and address records to surface aliases and prior residences. This is a non-biometric, automated lookup.
  • Identity verification — on screening tiers that include identity verification, your legal name, date of birth, the last four digits of your Social Security number, and your address, phone-number, and email history may be checked against records maintained by a payroll-data provider you connect to the Service (currently Pinwheel). The Service uses this data to confirm that the identity you have asserted matches identity attributes held by your payroll source. This is a non-biometric, attestation-based verification. The Services do not currently include driver's-license (DMV-record) verification, selfie capture, or facial-recognition matching.
  • Document authentication — where the screening includes document authentication, or where you choose to upload documents (such as pay stubs, W-2s, or tax forms) to verify your income instead of connecting a payroll account, those documents are submitted to our consumer-reporting partner Pinwheel CRA Co. (an affiliate of Underdog Technologies, Inc. d/b/a Pinwheel), which extracts the income information and assesses whether a document shows signs of alteration or tampering, as part of its consumer report. This assessment is performed by Pinwheel and is not facial-recognition, biometric, or selfie-matching technology; no biometric identifier is derived from your documents. A person reviews the results, and you keep all of the rights described in this disclosure, including the right to dispute the accuracy or completeness of any information used.
  • Income and employment verification — information about your income and employment, which may be obtained from your employer, from documents you upload (such as pay stubs, W-2s, or 1099s), or from a payroll-data provider you connect to the Service.
  • Prior-landlord reference calls — reference calls the Subscriber may place to landlords or other references you identify, using the AI Reference-Call Tool described in Part A.4 below. Reference-call output is collected by the Subscriber as part of its own due diligence and is not a Consumer Report furnished by us.
A.3 Who Will Prepare the Report.

We obtain Consumer Report information from the following independent companies, each of which is a consumer reporting agency or authorized data provider under the FCRA:

  • TransUnion LLC (credit reports, credit scores, identity-mismatch alerts, fraud alerts, OFAC screening) — 555 West Adams Street, Chicago, IL 60661 — transunion.com — (800) 916-8800.
  • One Source Technology, LLC d/b/a Asurint (criminal-history and housing-records reports) — 1111 Superior Avenue, Suite 420, Cleveland, OH 44114 (disputes by mail: P.O. Box 14730, Cleveland, OH 44114) — asurint.com — 1-800-906-2034 (consumer disputes).
  • Pinwheel CRA Co. (affiliate of Underdog Technologies, Inc. d/b/a Pinwheel; income and employment verification, identity verification) — getpinwheel.com.

We may add or change consumer reporting agencies from time to time. The current list will be available within the Services.

Separately, we make available an AI Reference-Call Tool described in Part A.4 below. Telephony and AI conversational technology for that tool is supplied by Vosy (vosy.ai), a service-provider vendor. Vosy is not a consumer reporting agency, does not furnish Consumer Reports, and does not maintain consumer files about you.

A.4 AI Reference-Call Tool.

The Subscriber may use an AI Reference-Call Tool through the Services to place reference calls to references you identify (typically prior landlords). The Subscriber configures the questions; an AI agent reads those questions to the contacted reference and records the responses. Telephony and AI conversational technology are supplied by Vosy as a service provider. The recording, transcript, and any AI-generated summary are delivered to the Subscriber as part of the Subscriber’s own due-diligence collection — this output is not a Consumer Report or an Investigative Consumer Report furnished by us, and we do not act as a consumer reporting agency in providing this tool.

Scope of the questions. The questions the Subscriber asks will be limited to tenancy-relevant matters such as your rental history, the condition in which you left prior properties, your conduct as a tenant, your timeliness in paying rent, and similar items. The Subscriber is responsible for not asking, and we will not include in our default question templates, any question soliciting information about your race, religion, national origin, sex, marital or familial status, sexual orientation, gender identity, disability, source of income, or other characteristics protected by fair-housing laws.

Call recording. Calls may be recorded and transcribed where lawful. Your authorization in Part E covers the placement and recording of these calls; the Subscriber and we comply with applicable federal and state call-recording and wiretap laws. You may withdraw consent to be contacted via the AI Reference-Call Tool at any time by writing to Contact@Lotly.ai.

A.5 How the Information Will Be Used.

The Consumer Report will be used by the Subscriber for the sole purpose of evaluating your application to rent residential property. It will not be used for any other purpose. The Subscriber is required by law to use the report one time only, not to share it with anyone other than you, and not to use the report to create or maintain a database of consumer information.

A.6 Lotly’s Role — Who Makes the Rental Decision.

Lotly Software LLC (lotly.ai) operates as a reseller of Consumer Reports under FCRA § 603(u). The Subscriber — the property owner or property manager identified on this application — is the sole decision-maker on your application. Lotly does not make tenancy decisions, does not approve, deny, or condition applications, does not score or rank applicants, and does not recommend any action on your application. Lotly does not modify Consumer Report content. Any decision to approve, deny, or condition your tenancy is made solely by the Subscriber, applying the Subscriber’s own criteria. If the Subscriber takes adverse action based in whole or in part on a Consumer Report, the Subscriber is responsible for providing you the notices the FCRA requires. Your dispute and privacy rights can be exercised at lotly.ai/privacy-choices or by writing to privacy@lotly.ai. Lotly’s full Privacy Policy is at lotly.ai/privacy.php; Terms of Service at lotly.ai/terms.php.

A.7 Where the Reports Are Stored.

Reports are stored in the United States with our service providers under appropriate security safeguards, and are retained for the periods described in our Privacy Policy.

PART B — SUMMARY OF YOUR RIGHTS

You have the following rights under the FCRA. A complete copy of "A Summary of Your Rights Under the Fair Credit Reporting Act" prepared by the Consumer Financial Protection Bureau is available at consumerfinance.gov.

  • You have the right to be told if information in your file has been used against you, such as to deny your rental application.
  • You have the right to know what is in your file. You may request a free file disclosure once every 12 months from each nationwide consumer reporting agency, and additionally if any company takes adverse action against you based on information in your file.
  • You have the right to dispute incomplete or inaccurate information in your file. The consumer reporting agency must investigate and generally must respond within 30 days.
  • You have the right to have inaccurate, incomplete, or unverifiable information corrected or deleted.
  • You have the right to have outdated negative information excluded from your report (generally, information older than seven years, or ten years for bankruptcies).
  • You have the right to limit access to your file. A consumer reporting agency may not provide your information to anyone without a permissible purpose.
  • You may seek damages from violators of the FCRA in federal or state court.
  • Identity-theft victims and active-duty military personnel have additional rights described in the full Summary of Rights.
PART C — ADDITIONAL DISCLOSURES FOR CALIFORNIA APPLICANTS

If you are a California resident, or you are applying to rent a property located in California, the following applies under the California Investigative Consumer Reporting Agencies Act (Cal. Civ. Code §§ 1786 et seq., the "ICRAA"):

C.1 Investigative Consumer Reports.

The criminal-history and housing-records reports obtained about you are Investigative Consumer Reports under the ICRAA. They are prepared by One Source Technology, LLC d/b/a Asurint, 1111 Superior Avenue, Suite 420, Cleveland, OH 44114, and delivered to the Subscriber by Lotly Software LLC as a reseller. You may check Box 3 below to receive a free copy of any such report at the time it is provided to the Subscriber. The AI Reference-Call Tool described in Part A.4 is a tool the Subscriber uses to collect reference information on its own behalf, with your consent, and is not a report furnished by us.

C.2 Your ICRAA Rights (Cal. Civ. Code § 1786.22).

You may inspect the files the agency keeps about you during normal business hours — in person (and you may bring one other person of your choosing), by mail, or by telephone; receive a written summary of the information in your file; be told who has requested your file; and have trained personnel explain any information to you. To exercise these rights or to dispute information in a report, contact the agency at the address above or contact us at the address in Part F.

C.3 Your General California Privacy Rights.

Independent of the ICRAA, California residents have privacy rights under the California Consumer Privacy Act and analogous state laws. Those rights are described in our Privacy Policy, Sections 15 and 16, and at lotly.ai/privacy-choices.

PART D — ADDITIONAL DISCLOSURES FOR OTHER STATES

Various states have laws giving applicants rights similar to or in addition to the FCRA.

D.1 Minnesota and Oklahoma.

You have the right, upon request, to be informed whether or not a Consumer Report was procured.

D.2 New Jersey.

Under the New Jersey Fair Credit Reporting Act, the Subscriber must disclose certain information about the Consumer Report and your rights, similar to the federal FCRA disclosure above. You have the right to access your file, dispute inaccurate information, and limit access to your file.

D.3 Washington.

Under Washington law (RCW 19.182), you have the right to receive, upon request and free of charge, a written summary of all information contained in our files about you at the time of the request. We do not currently prepare Investigative Consumer Reports about Washington applicants — the AI Reference-Call Tool described in Part A.4 is a Subscriber-conducted reference-collection tool, not an Investigative Consumer Report furnished by us. If a Subscriber separately procures an Investigative Consumer Report from another agency, that agency is responsible for the additional Washington disclosures.

D.4 Maine.

Under Maine law (10 M.R.S. § 1316), upon written request, you have the right to be informed of whether a Consumer Report has been prepared on you and, if so, to receive a complete and accurate disclosure of the nature and scope of the report.

D.5 Vermont, Massachusetts, and New York.

Lotly does not currently provide Services in connection with properties located in Vermont, Massachusetts, or New York.

D.6 Other States.

If you reside in another state with applicable consumer-reporting laws, you may have additional rights under the consumer-reporting laws of California, Colorado, Connecticut, Illinois, New Jersey, Texas, and Washington. Please consult those state laws or contact your state attorney general’s office for more information.

PART E — AUTHORIZATION

I further authorize the Subscriber to use the AI Reference-Call Tool described in Part A.4 to contact references I have identified, and consent to the recording and transcription of those calls where lawful. This Authorization is voluntary, and I may withdraw it at any time by writing to Contact@Lotly.ai, except that withdrawal will not affect the validity of any report procured or any call placed before withdrawal.

Verification of Provided Identification

Each applicant is required to provide a copy of a legible and valid Government issued photo identification, for example a Passport, Driver’s License, or State ID.

Review and Verification of Income for Each Applicant

Income must be at least three (3) times the monthly rent and verifiable from an unbiased source: employer through pay stubs, tax returns, and/or bank statements. Self-employed income may also be verified with a CPA-prepared financial statement or tax returns. Your employment history should reflect at least 6 months with your current employer. Transfers or relocations must have correspondence showing an accepted job offer. Any verification fees required by the employer must be paid by the applicant. Section 8 tenants must provide a copy of their Voucher.

Review and Verification of Employment History

We require verifiable employment history for at least the past three (3) years. You must be a permanent employee (not temporary or probationary). If you are self-employed, retired, or not employed, we can accept signed tax returns (2 years minimum), bank statements, or other proof of applicant’s ability to pay the rent. If military, we need a current copy of your LES. If you are active-duty military, you must be on an assignment that, to the best of your knowledge, will allow you to complete an initial 12-month lease.

Review and Verification of Rental History

We require verifiable residence history for at least three (3) years, whether you currently own or rent. Applicants are responsible for providing information including the names, addresses and phone numbers, of Landlords with the dates of tenancy for the previous 3 years. Rental history must be verified from unbiased sources. Home ownership will be verified from a current credit report. We can accept base housing as rental history.

Housing Records

Any housing-related court action may be automatic grounds for denial. Broken leases will be considered on a case-by-case basis.

Household Size

A pregnant woman is considered to be a two-person household.

Any live-in aide (approved by the PHA to reside in the unit to care for a family member who is disabled or is at least 50 years of age) will be counted-in to determine the unit size. A maximum of one bedroom will be allocated for live-in aides, even if the family has more than one aide.

A child who is temporarily away because he/she is in foster care is considered a member of the family in determining the unit size.

Unit sizes and the Maximum Occupancy are as follows:

0BR= 2

1BR= 4

2BR= 8

3BR= 10

4BR= 14

Errors & Omissions

Every effort has been made to provide applicants with reliable and accurate information regarding the home you are applying for. However, changes can and do take place to cause inaccurate information to be accidentally presented. We encourage all tenants to verify schools, allowable pets, expected features, or any HOA concerns prior to signing a lease agreement. Any information posted in any advertisement, the MLS, or websites does NOT constitute a written agreement or guarantee of the facts stated.

Credit History Review and Verification

We will obtain a copy of your credit report from TransUnion. You cannot provide this to us. We will not accept any third-party credit report. Credit history should show that the resident has paid bills on time and does not have a history of debt “write-offs” or accounts that have gone into collection. Money owed to a previous landlord or utility company may be cause for denial.

For multiple applicants we use an average combined Transunion credit score by adding all applicants scores together and dividing them by the number of applicants to arrive at the determining number for the approval process. For example:

Applicant ONE has a Transunion credit score of 700, and Applicant TWO has a Transunion credit score of 550.  The total score would be 700+550=1,250; divide by two applicants 1,250/2= 625. The average combined Transunion credit score would be 625.

Co-signers are welcomed to help increase your credit score if needed. However, they must be residing in the same home as you to be considered.

We accept Transunion credit score evaluations. Our minimum Transunion Credit Scores are as follows:

Minimum Transunion credit score is 600+

Review and Verification of Pet Screening Application

LCG Communities is a pet friendly property management company. We understand that a pet plays a significant role in many people’s lives. We attempt to allow most animals in our rental properties. Depending on the property owner’s preferences, each residence may have its own pet policy, so please make sure to ask if the property that has caught your eye accepts pets.

LCG Communities reserves the right to have any pet removed from the property if it is determined that the pet poses a threat to the safety or condition of the property, or people in the property, or the community.

We may charge a pet fee each month, for each of your pets. The term “pet fee” is simply a fee you will pay for the allowance of your pet to occupy the rental unit with you. Pet fees are charged monthly and are paid with your property rent:

ONLY approved pets that have been disclosed to Management are allowed in our residences.

Renters Liability Insurance with Pet Endorsement may be required.

You may obtain a copy of our pet policy by requesting it from Contact@LCGCommunities.com. It is also disclosed in the Park Rules and Regulations you will receive before signing the lease.

Pet Fees:

Dogs/Cats/etc are a non-refundable one-time upfront fee of $50.00 per pet.

Birds (per cage): Small Breeds (ie. Budgies & Finches) $10; Large Breeds (ie. Parrots & Cockatoos) $25.

Caged pets (per pet): Hamsters, Gerbils, Guinea Pigs, Reptiles, Ferrets, Amphibians, etc. $10.

Fish Tanks (per tank): $10 per 10 gallons. Max of 40 gal.

Farm or Exotic Animals will be assessed on Cased-By-Case Basis.

There is no cost to you for Assistance Animals. Please make sure you are aware of the State’s laws, for submitting a fraudulent accommodation request for a service or support animal. All request for a service or support animal will be verified.

Short Term Lease Agreement Option

Short Term leases are not allowed at LCG Communities. All leases are a minimum of 1 year.

Criminal Background Check

State law allows landlords to perform criminal background checks after a prospective tenant has been pre-qualified. We may perform criminal background checks for all occupants over 18 after they have been prequalified:

All applications are considered on a first come, first approved, first served basis.

Once the criminal background check has been performed, we will provide the criminal background data obtained to the applicant within five (5) business days on request.

Sexual offenses within a conviction history, regardless of when it occurred, may result in a denial of housing.

Past criminal convictions within three (3) years may result in a denial of housing. The applicant will have five (5) business days to dispute any inaccuracies in the criminal history. A final decision, following the applicant’s opportunity to dispute period, will be made within three (3) business days.

Security Deposit Insurance or a Bond

To ease the burden of having to pay a large upfront amounts of money, LCG Communities typically does NOT collect Security Deposits. Applicants may have the opportunity to either choose to purchase security deposit insurance, or a bond.

Tenants are Responsible for all Damage to the Property

At the end of Lease Agreement and after tenant moves out, LCG Communities will conducts a move out inspection to assess any damage to the property, above normal fair wear and tear. In the event there is property damage, above normal fair wear and tear, the tenant will be responsible for the cost of the repairs.

Mandatory Limited Liability Insurance or Renters Insurance

Limited Liability Insurance or Renter’s Insurance may be required. The tenant must purchase at his/her own cost either subscribe to LCG Communities Limited Liability Insurance with $100,000 coverage for $15/m, or provide proof of Renter’s Insurance and present a Certificate of Insurance (ACORD Form 24 or 25) naming LCG Communities as the Additional Insured, or Co-Insured, Certificate Holder/with Endorsement with a minimum $100,000 of Liability Coverage Limit.

In the event the tenant does not provide proof of Renter’s Insurance prior to moving-in, the tenant agrees to be automatically enrolled at tenant’s expense into LCG Communities’s Limited Liability Insurance with $100,000 in coverage at a monthly fee of $15 in addition to the monthly rent.

No Smoking, Tobacco-Free Properties

Smoking is a leading cause of preventable death and property damage in the United States. Smoking and secondhand smoke are known causes of lung disease, heart disease, and cancer. LCG Communitiess recognizes the hazards caused by tobacco use and exposure to secondhand tobacco smoke. This policy covers the smoking of any tobacco product, including smokeless tobacco products, and electronic cigarettes (regardless of tobacco content), and it applies to both tenants and visitors of LCG Communitiess properties. Smoking is not allowed in all common areas.  Smoking is permitted away from common areas or neighbor’s lot boundaries.

School Boundaries and School Enrollment

It is the duty of the applicant to verify school boundaries prior to applying. Any concerns about school boundaries and school enrollment should be investigated prior to submitting your application. Designation boundaries may change, applicants must verify their own school information with the school district. We highly recommend that you contact the local school district if the school boundaries are a concern for the property you would like to rent.

Disabled Accessibility

Any concerns should be submitted in writing to the property manager. We must obtain Owner’s approval to allow modifications to the property. All modifications are to be performed at the expense of the disabled person, and the disabled person must agree to restore the premises, at their own expense to the pre-modified condition (provided the modification would affect the use and enjoyment of the premises for future residents). We require written proposals detailing the extent of the work to be done, approval from the landlord before modifications are made, appropriate building permits with required licenses made available for the landlord’s inspection, and a restoration deposit may be required per Fair Housing guidelines.

Home-Based Business

Businesses are not allowed to be operated from a residential property. If you have a home-based business that you think we might approve, please let the Property Manager know prior to application.

Periodic Inspections

LCG Communities conducts periodic inspections of the property you will live in. A prior notice of inspection will be given in accordance with the law. We take pictures of the exterior during that inspection. This information is kept on record and shared with the property owner. If this standard of periodic inspections procedure is going to cause you a problem, we recommend you stop now and do not apply for one of our properties.

Showing the Property During the Last 60 Days of Your Lease

If you are not renewing your lease, during the last 60 days of your lease agreement, a sign may be placed on the property, and you may be required to show the property to prospective new tenants. You may opt out of this arrangement, but it will cost an additional fee of one month’s rent to do so.

Late fees begin midnight on the 5th day of the month. Late fees will be applied with no exceptions in accordance with all Federal Fair Housing laws.
